Terms of service

These Terms of Service apply to customers in the Republic of Ireland and Northern Ireland who use our website or place an order with Ecofuel Store Ireland Limited, trading under the ECOFUEL™ brand.

Ecofuel Store Ireland Limited remains the contracting seller for Northern Ireland orders.

Please read these Terms before using our website or placing an order. We have written them to explain how our website works, how orders are handled, and how our Shipping Policy and Return and Refund Policy apply.

These Terms do not affect any statutory rights that apply to consumers.

1. Who we are

This website is operated by Ecofuel Store Ireland Limited, trading under the ECOFUEL™ brand.

In these Terms, “ECOFUEL™”, “we”, “us” and “our” mean Ecofuel Store Ireland Limited.

2. What these Terms apply to

These Terms apply to your use of our website and to products ordered from Ecofuel Store Ireland Limited through our website, draft orders, phone-assisted orders and payment-link orders.

These Terms apply to consumers and to business customers. Some sections apply differently to business customers, and this is explained where relevant.

If a separate written agreement applies to a B2B or commercial order, that separate written agreement will apply to that order where it conflicts with these Terms. Nothing in these Terms or any separate agreement excludes any mandatory legal rights that cannot lawfully be excluded.

These Terms should be read together with our related policies, including our Shipping Policy, Return and Refund Policy and Privacy Policy.

Where a delivery, cancellation, return, refund, delivery issue, return collection or failed-delivery matter is covered in more detail by our Shipping Policy or Return and Refund Policy, the more specific policy applies, unless these Terms, a separate written agreement or applicable law require a different result.

3. Using our website

You may use our website only for lawful purposes.

You must not use our website in a way that:

  • breaks any applicable law or regulation;
  • interferes with the security, operation or availability of the website;
  • introduces viruses, malware, harmful code or similar material;
  • attempts to gain unauthorised access to our systems, accounts, customer data or third-party systems;
  • copies, scrapes, extracts or reuses website content in a way that is not permitted by these Terms or by law;
  • misuses the website, checkout, customer-account system, rewards programme, referral programme, reviews, contact forms or any other website feature;
  • impersonates another person or business;
  • provides false, misleading or fraudulent information;
  • infringes our intellectual property rights or the rights of any third party.

We may suspend or restrict access to the website, customer accounts or ordering functions where we reasonably believe there has been misuse, fraud, attempted fraud, security abuse, unlawful activity or a breach of these Terms.

4. Customer accounts and customer information

You may need to provide information such as your name, email address, phone number, billing address, delivery address, payment details and order instructions when placing an order or using a customer account.

Please make sure the information you provide is accurate, complete and up to date.

If you create or use a customer account, you are responsible for keeping your account access secure. You should not allow another person to use your account unless you are responsible for their use of it.

If you order on behalf of a business, company, organisation or another person, you confirm that you have authority to place that order.

If order details, delivery details or contact details are incorrect or incomplete, your order may be delayed, paused, cancelled or subject to further review.

5. Consumers and business customers

A consumer is a customer acting for purposes that are wholly or mainly outside their trade, business, craft or profession.

A business customer is a customer acting in the course of business, trade, craft or profession, or placing an order for commercial, resale, operational or organisational use.

Where it is unclear whether a customer is acting as a consumer or as a business customer, ECOFUEL™ will treat the customer as a consumer unless the order information clearly shows that the customer is acting in the course of business.

Business customers do not have consumer-style change-of-mind cancellation rights. Business cancellations, refusals and returns of correct and undamaged goods are subject to ECOFUEL™’s agreement, any applicable commercial terms and any mandatory legal rights that apply.

6. Products and product information

We aim to describe our products clearly and accurately.

Product information on our website may include descriptions, images, packaging information, weights, dimensions, instructions, suitability notes, safety information, sustainability information, certification information, stock status and other product details.

Product images are for guidance. Actual product appearance, packaging, colour, shape, size, texture or finish may vary slightly because of natural product variation, supplier changes, packaging updates, screen settings, photography and normal production differences.

Many ECOFUEL™ products are natural, bulky, heavy or moisture-sensitive fuel products. Please follow any product information, storage guidance, safety instructions and suitability notes shown on the product page, packaging or related customer information.

We may update product descriptions, product information, packaging, specifications, pricing, availability or product ranges from time to time.

Nothing in this section limits your rights where goods are faulty, damaged before delivery, short, incorrect, misdescribed or otherwise not supplied in accordance with your legal rights.

7. Availability and product limits

All products are subject to availability.

We may limit quantities, pause sales, refuse an order, cancel an order or contact you before accepting or fulfilling an order where there is a stock issue, pricing error, product error, delivery issue, payment issue, suspected fraud, unusually large order, business-customer credit issue, geographic delivery issue or another reasonable operational or legal reason.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled item or order, unless another lawful arrangement applies.

8. Prices, VAT, currency and delivery charges

Prices are shown before you complete your order.

The final product price, any VAT or tax shown, any delivery charge and the order total will be shown at checkout, on the draft order, invoice, payment request or other order document before the order is completed.

Republic of Ireland orders are normally shown and processed in euro.

Northern Ireland orders may be shown and processed in pounds sterling. Ecofuel Store Ireland Limited remains the contracting seller for Northern Ireland orders.

Refunds are normally processed in the currency used for the original order.

Prices, delivery charges, discounts and promotions may change for future orders. A change to future pricing does not change the price of an order that has already been accepted unless you agree to a changed order arrangement or the order is affected by an obvious pricing, tax, delivery or technical error.

If a product price, delivery charge, discount, VAT amount, product description or order total is clearly incorrect because of an error, we may contact you to correct the error, ask whether you want to proceed at the correct price, or cancel and refund the affected order.

9. Discounts, promotions, rewards, referrals and store credit

Discount codes, promotions, bundle offers, free-gift offers, multi-buy offers, reward points, loyalty rewards, referral rewards, product rewards, store credit and other offers may be subject to specific conditions.

Unless we state otherwise, promotions, reward offers, referral offers and discount codes are available for a limited time, cannot be exchanged for cash, may not be combined with other offers, and may be changed, paused or withdrawn for future orders.

Reward points, loyalty benefits, referral rewards, product rewards, reward discount codes and similar programme benefits are promotional benefits. They are not cash, gift cards, electronic money, deposits, bank balances or stored-value accounts unless we expressly state otherwise.

Rewards and referral benefits may depend on customer-account status, order value, product availability, delivery territory, customer eligibility, stock availability, technical settings, fraud checks, minimum-order requirements, programme rules, third-party app or platform settings, or other conditions shown at the time.

Store credit may be offered as an option. Consumers are not required to accept store credit instead of a refund where they are legally entitled to a refund. If you choose store credit, we will confirm the amount and any relevant conditions before applying it.

If an order is returned, cancelled, partly returned, partly cancelled, refunded, charged back or adjusted, we may adjust, reverse or remove any discount, reward points, loyalty benefit, referral reward, product reward, store credit, bundle price, free gift, promotional value or offer benefit linked to that order.

We may pause, refuse, reverse or remove discounts, reward points, loyalty benefits, referral rewards, product rewards, store credit or promotional benefits where we reasonably believe there has been misuse, fraud, attempted fraud, technical abuse, duplicate-account abuse, self-referral, referral abuse, review abuse, chargeback abuse, unauthorised resale activity, spam, misleading sharing, automated activity or another breach of these Terms.

Referral links and referral offers must be used honestly and lawfully. You must not use referral links for spam, unsolicited marketing, fake accounts, self-referrals, paid advertising, coupon sites, automated sharing, misleading promotions or any other activity that we reasonably consider abusive, unlawful or inconsistent with the purpose of the referral programme.

Rewards, referrals and related customer-account features may be provided through a third-party app or technical platform. If that app, platform or website feature is unavailable, delayed, changed, discontinued or affected by a technical issue, we may pause, adjust, replace or withdraw the relevant reward or referral feature where reasonable.

We may change, suspend or withdraw a rewards programme, referral programme, reward type, earning method, redemption method, reward value, product reward, discount code or programme feature. Where practical, we will try to give reasonable notice of material changes affecting unused valid rewards.

Changes will normally apply to future earning or future redemption unless a reward has to be adjusted because of fraud, abuse, technical error, return, refund, chargeback, stock issue, legal risk, platform or app change, or circumstances outside our reasonable control.

Sale items and promotional items are not automatically excluded from our Return and Refund Policy.

Where a reward page, referral page, loyalty programme rule, promotion rule, offer condition or customer-account feature gives more specific conditions for a reward or referral benefit, those specific conditions also apply. If there is a conflict, the more specific rule applies unless these Terms, our Return and Refund Policy or applicable law require a different result.

10. Gift cards

ECOFUEL™ gift cards are digital gift cards unless we state otherwise.

Gift cards are reviewed manually where cancellation, refund or return questions arise because ECOFUEL™ needs to check whether the gift card has been issued, used, partly used or unused.

Unused and wholly unredeemed digital gift cards may be cancelled and refunded under our Return and Refund Policy or where otherwise required by law.

If a gift card has been used in full or in part, this may reduce or prevent a refund, except where the law requires otherwise.

ECOFUEL™ gift cards do not currently have an expiry date.

11. Placing an order

When you place an order, you are making an offer to buy the products in that order.

For website orders, you may receive an order confirmation or see an order-status page after the order is submitted. This confirms that the order has been received.

We normally accept a website order when we send the order confirmation. For draft orders, phone-assisted orders, payment-link orders or business orders, acceptance may depend on the order setup, payment status, credit terms, stock availability, delivery arrangement or written confirmation from ECOFUEL™.

In a small number of cases, we may need to contact you after an order is placed if there is a genuine issue with stock, payment, delivery, access, suspected fraud, an obvious pricing or product error, a business-customer credit issue, or another reasonable operational or legal reason. Depending on the issue, we may pause the order, ask for more information, agree a change, cancel affected items, cancel the order and refund any amount paid, or agree another lawful solution.

A draft order, checkout screen, payment link, payment attempt or payment authorisation does not always mean that the order has been accepted.

If we do not accept an order, or if we cancel an order after payment has been made, we will refund the amount paid for the cancelled item or order unless another lawful arrangement applies.

12. Reviewing your order before submission

Before submitting an order, please review the product, quantity, price, delivery address, billing details, contact details, delivery instructions, delivery method, delivery charge and order total.

You are responsible for correcting any input errors before submitting the order.

If you notice an error after placing an order, contact us as soon as possible at hello@ecofuel.ie or +353 91 444 760. We will try to help where practical, but changes may not be possible once an order has moved into preparation, fulfilment, dispatch or delivery.

13. Payment

You must pay for your order using one of the payment methods available for that order unless we have agreed credit terms or another written payment arrangement.

By submitting payment details, you confirm that you are authorised to use the relevant payment method.

Payments may be processed by payment providers, card issuers, banks or other third-party payment services. Those services may apply their own terms, security checks, authorisation processes and processing times.

If payment is refused, reversed, disputed, charged back, flagged for review or not completed, we may pause, cancel or review the order.

For business customers with agreed credit terms, payment timing, invoicing, credit notes and account adjustments may be handled under the agreed commercial arrangement.

14. Draft orders, phone-assisted orders and payment links

These Terms apply to draft orders, phone-assisted orders and payment-link orders unless a different written agreement applies.

For draft orders, the customer may receive an order confirmation after the order is created or paid, depending on the order setup.

Some business draft orders may be unpaid at the time they are created because the customer has credit terms.

Where we agree a specific product, price, delivery charge, delivery date, delivery site, pallet delivery point, commercial instruction or other order-specific arrangement for a draft order, invoice or payment request, that arrangement applies to that order.

Order handling may depend on whether the order has been paid, accepted, fulfilled, dispatched, delivered, supplied on credit terms, or otherwise agreed with ECOFUEL™.

15. Delivery and shipping

Delivery is handled under our Shipping Policy.

Our Shipping Policy forms part of these Terms and explains delivery areas, delivery charges, delivery estimates, delivery methods, customer delivery information, access requirements, pallet and heavy deliveries, safe-place delivery, delivery completion, failed delivery, split deliveries, delivery issues, business deliveries, draft orders, phone-assisted orders and payment-link orders.

Delivery options and charges are shown before you complete your order. For draft orders, phone-assisted orders or payment-link orders, we will show or agree the delivery charge before the order is completed.

Delivery estimates are estimates only unless we have expressly agreed in writing before the order is completed that delivery by a specific date is essential.

Nothing in this section affects consumer statutory rights.

16. Cancellation, returns and refunds

Cancellations, returns and refunds are handled under our Return and Refund Policy.

Our Return and Refund Policy forms part of these Terms and explains cancellation requests, return requests, 30-day free consumer returns, return collections, failed return collections, refunds, damaged or incorrect goods, gift cards, promotions, business-customer returns, draft orders, phone-assisted orders, payment-link orders and Northern Ireland orders.

Eligible consumer orders have a 30-day free return window. The 30 days starts from the day you receive your order, or from the day the last item is delivered if your order arrives in more than one delivery.

Our team reviews every request manually. Submitting a request does not automatically cancel an order, approve a return or issue a refund.

Nothing in this section affects consumer statutory rights.

17. Customer instructions, delivery notes and safe-place requests

Customers may provide delivery notes, access information or safe-place instructions when placing an order or by contacting us before delivery.

Customer instructions must be clear, practical, safe and suitable for the products and delivery method.

Many ECOFUEL™ products are sensitive to rain, damp and moisture. Product packaging, pallet wrap and outer packaging are intended to protect goods during normal handling and delivery, but they are not designed for long-term outdoor storage or prolonged exposure to weather.

Safe-place delivery, unattended delivery, delivery completion and risk after delivery are handled under our Shipping Policy and Return and Refund Policy.

18. Damaged, missing, short, incorrect or defective goods

If goods arrive damaged, missing, short, incorrect or defective, contact us at hello@ecofuel.ie as soon as reasonably possible.

To help us investigate delivery or product issues, please keep the goods and packaging where practical and provide photographs of any visible damage, incorrect goods, shortage, delivery location or packaging condition.

If a consumer cannot provide a photograph or keep packaging, ECOFUEL™ will still review the issue based on the information reasonably available. This does not affect statutory rights.

Delivery issues, remedies, replacements, refunds and related handling are dealt with under our Return and Refund Policy and Shipping Policy.

19. Business customers and commercial orders

Business customers are responsible for making sure the products ordered are suitable for their business, premises, equipment, storage, operational use and delivery requirements.

Business customers must provide accurate delivery information, business opening hours, delivery windows, loading-bay restrictions, access requirements and site-specific instructions before delivery where relevant.

Business customers must inspect deliveries promptly. Visible damage, shortages, incorrect goods or disputed delivery must be reported within 48 hours of delivery. If that period ends on a weekend or public holiday, the issue should be reported by the next working day. Issues that could not reasonably have been identified on delivery should be reported as soon as reasonably possible after discovery.

Business cancellations, refusals and returns of correct and undamaged goods are subject to ECOFUEL™’s agreement, any applicable commercial terms and any mandatory legal rights that apply.

Where a business order is on credit terms, any refund or adjustment may be handled by credit note, account adjustment or another agreed commercial process.

20. Third-party services and external links

Our website may use third-party services to help operate the store, process payments, manage customer accounts, provide maps, support reviews, operate rewards or referral features, arrange delivery, prevent fraud, or provide other website and customer-service functions.

Sales and purchases made through our website are made directly with Ecofuel Store Ireland Limited.

Our website may include links, embedded tools, payment services, maps, review tools, customer-account tools, rewards tools, referral tools or other third-party services. These services may have their own terms and privacy information.

We are not responsible for the content, policies, availability or operation of third-party websites or services that are not controlled by us.

You should review the terms and policies of any third-party website or service before using it or relying on it.

21. Privacy

Personal information is handled under our Privacy Policy.

Our Privacy Policy explains how personal information is collected, used, shared and protected.

Personal information may be processed by third-party service providers where needed to operate the website, process orders, take payments, deliver goods, handle customer service, operate customer-account features, operate rewards or referral features, prevent fraud, or comply with legal obligations.

Nothing in these Terms replaces our Privacy Policy.

22. Intellectual property, trade marks and brand use

The website, product information, product descriptions, photographs, graphics, logos, trade marks, registered trade marks, unregistered trade marks, product names, brand names, page layouts, text, designs, packaging designs and other content are owned by, licensed to, or used by Ecofuel Store Ireland Limited with permission, unless stated otherwise.

Trade marks, logos, product names, service names and brand assets belonging to third parties remain the property of their respective owners. Any third-party trade marks or brand names shown on our website are used for identification, service, compatibility, payment, delivery, certification, platform, partner, supplier or informational purposes only, unless we state otherwise.

You may use our website for normal browsing, shopping, customer-account use and communication with ECOFUEL™.

You must not copy, reproduce, modify, publish, distribute, sell, scrape, extract, exploit or use our website content, product content, images, logos, trade marks, product names, packaging designs or brand assets for commercial purposes without our prior written permission, unless the law allows it.

You must not use our trade marks, logos, product names, packaging designs or brand assets in a way that suggests that you are ECOFUEL™, that you are authorised by ECOFUEL™, that you are affiliated with ECOFUEL™, or that ECOFUEL™ has approved, sponsored or endorsed your business, product, service, website, advertisement, marketplace listing, social media account, domain name or other activity, unless we have agreed this in writing.

Business customers, resellers and commercial partners may refer to genuine ECOFUEL™ products using the correct product names where this is necessary to identify those products accurately. This does not give any right to alter our branding, copy website content, use logos, create misleading advertising, register similar names or domains, or present themselves as an authorised ECOFUEL™ partner unless this has been agreed in writing.

Nothing in these Terms transfers ownership of any trade mark, logo, product content, image, packaging design, brand asset or other intellectual property right to you.

23. Reviews, feedback and customer submissions

Customers may be able to submit reviews, comments, photos, videos, feedback, questions or other content through our website, email, review platforms, rewards programme, referral programme, social media or other customer-service channels.

Please make sure anything you submit is accurate, genuine, lawful and does not infringe the rights of another person or business.

Please do not submit photos, videos or content showing another person, private property, vehicle registration, address or other personal information unless you have permission or the content can lawfully be shared.

You must not submit content that is false, misleading, abusive, defamatory, obscene, unlawful, discriminatory, threatening, spam, malicious, infringing or harmful.

If a reward, discount, loyalty benefit or other incentive is offered for submitting a review, photo, video or other content, the reward is not conditional on giving a positive review. Any review or content you submit should reflect your genuine experience.

If you share content publicly and you have received, or may receive, a reward, discount, loyalty benefit, free product or other incentive, you may need to disclose that incentive. You are responsible for making any disclosure required by law.

Where you submit a review, photo, video, comment or feedback, you allow ECOFUEL™ to use, display, reproduce and share that content for customer-service, website, review, marketing, product-improvement and business purposes, unless a separate agreement or applicable law says otherwise.

We may moderate, remove or decline to publish customer content where we reasonably consider it unlawful, misleading, fake, abusive, irrelevant, inappropriate, commercially sensitive, fraudulent, spam, incentivised without proper disclosure, infringing or inconsistent with these Terms.

We may withhold, reverse or remove any related reward, discount, loyalty benefit or promotional benefit where content is false, misleading, fake, abusive, infringing, submitted through duplicate accounts, or otherwise inconsistent with these Terms.

24. Website availability and errors

We aim to keep the website available and accurate, but we do not guarantee that the website will always be uninterrupted, secure, error-free or available at all times.

We may update, suspend, withdraw, maintain or change all or part of the website where needed.

We may correct errors, inaccuracies or omissions on the website, including errors relating to product descriptions, pricing, promotions, delivery charges, availability, transit estimates or other information.

If an error affects an order, we may contact the customer to correct the issue, agree the next step, or cancel and refund the affected order where appropriate.

Nothing in this section affects consumer statutory rights.

25. Our responsibility to consumers

Nothing in these Terms excludes or limits any statutory rights that apply to consumers.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

If you are a consumer, we are responsible for losses you suffer that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, but we are not responsible for losses that were not foreseeable.

We are not responsible for business losses suffered by consumers, including loss of profit, loss of business, business interruption or loss of business opportunity.

26. Our responsibility to business customers

This section applies to business customers only.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, deliberate misconduct, or any other liability that cannot legally be excluded or limited.

Subject to the paragraph above, ECOFUEL™ will not be liable to business customers for indirect or consequential loss, loss of profit, loss of sales, loss of revenue, loss of goodwill, loss of business opportunity, business interruption, loss of anticipated savings, loss of data, or losses arising from resale, onward supply, customer contracts or third-party claims.

Subject to the paragraphs above, ECOFUEL™’s total liability to a business customer for an order will not exceed the amount paid or payable for the affected order, unless a separate written agreement states otherwise or the law requires otherwise.

Nothing in this section excludes mandatory legal rights that apply to business customers.

27. Events outside our reasonable control

We are not responsible for delay or failure to perform where the delay or failure is caused by events outside our reasonable control.

This may include severe weather, flooding, fire, accident, vehicle breakdown, fuel shortage, supplier disruption, stock shortage, carrier disruption, strikes, labour disruption, public holidays, port or ferry disruption, customs or regulatory delay, power failure, internet or platform outage, cyber incident, government action, legal restriction, epidemic, pandemic or other operational disruption outside our reasonable control.

Where an event outside our reasonable control materially affects an order, we will contact the customer where practical to provide an update, agree a revised arrangement, cancel the order, refund the order, or agree another appropriate solution.

This does not affect consumer statutory rights.

We will review complaints and customer-support issues based on the information reasonably available.

29. Governing law and disputes

These Terms and any contract between you and Ecofuel Store Ireland Limited are governed by the laws of Ireland, unless mandatory consumer protection rules require otherwise.

If you are a consumer in Northern Ireland, nothing in these Terms removes any mandatory consumer rights or protections that apply to you and cannot legally be excluded.

If you are a consumer, you may have the right to bring proceedings in the courts of the place where you live or another court available to you under mandatory law.

If you are a business customer, the courts of the Republic of Ireland will have exclusive jurisdiction over disputes arising from or relating to these Terms, an order, or a contract with Ecofuel Store Ireland Limited, unless a separate written agreement states otherwise or mandatory law requires otherwise.

30. Changes to these Terms

We may update these Terms from time to time.

The version published on our website is the current customer-facing version.

Changes will apply to future use of the website and future orders. They will not normally change the terms of an order already accepted unless the change is required by law, agreed with the customer, or relates to a correction that lawfully applies to that order.

Where required by law, we will notify customers of material changes in an appropriate way.

31. Severability

If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be treated as removed or limited to the minimum extent necessary, and the remaining parts will continue to apply.

32. No waiver

If we do not enforce a right under these Terms, this does not mean that we have waived that right.
